CVR and HollyFrontier File Petitions with Supreme Court to Review January Ruling on Small Refinery Exemptions

The 10th Circuit Court of Appeals ruled in January that three specific waivers granted by the EPA were ineligible for receiving small refinery exemptions (SRE).  The three waivers effected in this case belonged to CVR and HollyFrontier. While this case involved just three of dozens of waivers received every year by EPA, it represents a tipping point in the ongoing waiver battle.  If these three were excluded, all but maybe two or three exemptions may be allowable in the future.
