EPA Proposes Settlement on Issuing 2021, 2022 RVO’s

 

EPA Seeks Comment on Proposed Consent Decree

The Environmental Protection Agency (EPA) filed notice in the Federal Register today, seeking comment on a proposed consent decree that would establish deadlines forthe 2021 and 2022 renewable fuel standards by June 3, 2022.

The consent decree follows a February 8 complaint filed by Growth Energy alleging EPA failed to perform non-discretionary duties in accordance with the Clean Air Act to establish renewable fuel standards for calendar years 2021 and 2022.

A consent decree is an agreement or settlement that resolves a dispute between two parties without admission of guilt or liability. Written comments on the proposed consent decree must be received by March 25, 2022.
