Refiners Challenge Denial of 26 Small-Refinery Exemptions

Four refiners are seeking U.S. appeals courts review of the EPA’s July action that denied 26 petitions for small refinery exemptions (SREs) under the Renewable Fuel Standard (RFS), according to media reports. The companies are: Hunt Refining Company, San Antonio Refining Company, Calumet Shreveport Refining and Calumet Montana Refining.

On July 14, the EPA announced the denial of 26 SRE petitions for compliance years spanning 2016 through 2023, leaving just two waivers outstanding. In the action, 11 SREs were denied for 2022 and 11 were denied for 2023. One SRE was denied in each of the following years, 2016, 2017, 2018, and 2023. Two SREs remain for 2018.
