CARB to resubmit LCFS amendments after Office of Administrative Law rejection

The California Air Resources Board (CARB) will address concerns and resubmit amendments to the state’s Low Carbon Fuel Standard (LCFS) after its originally proposed changes were rejected by the California Office of Administrative Law (OAL), CARB said in a statement on Wednesday February 26.

CARB — which made the announcement after receiving more detailed information from the OAL regarding last week’s rejection — said that proposed modifications will be substantive enough that it will need to open another public comment period.

In its decision, OAL cited clarity issues, pointing out 26 proposed regulatory provisions in which additional modifications may be necessary to ensure they can be “easily understood by those persons directly affected by them.”
