Clean Fuels Alliance America plans to sue the US Environmental Protection Agency (EPA) for the agency’s decision to delay the release of federal Renewable Volume Obligations (RVOs) for 2026, the group said in a formal letter of intent on Wednesday July 17.
Under the Renewable Fuel Standard (RFS) — the primary piece of legislation covering US biofuel policy — the EPA is required to set biofuel blending volumes 14 months before the start of the compliance year. For 2026, that would put the original deadline for 2026 volumes on October 31, 2024.
But the EPA will miss that deadline and will delay proposing 2026 RVO targets until March 2025, the White House Office of Management and Budget (OMB)’s 2024 Unified Agenda and Regulatory Plan, released in early July, showed.
