EPA Rejects Gap-Year Waiver Requests

Small Refinery Exemptions Rejected

The EPA has yet to update their “RFS Small Refinery Exemptions” dashboard which shows a total of 98 pending small refinery exemptions (SREs), 67 of which are gap-year requests, 28 are for 2019, and three are for 2020. However, Reuters is reporting the Trump Administration on Monday rejected scores of SRE requests from refiners.  If they had been granted, they would have spared refiners from retroactive blending obligations and, more importantly, set them up to continue receiving waivers in the future.

During the Trump’s tenure, waiver petitions had grown from 14 to a peak of 42 in 2018, while petitions granted climbed from seven to 35. The exemptions reduced the amount of renewable fuel that was obligated to be blend with transportation fuel.  In 2015, 290 million gallons of renewable…
