Federal Action on Delta-8 THC Looms

As Delta-8 THC (∆8) makes its way through state legislatures en masse, the DEA is poised to advance new proposed rules to prohibit manufactured cannabinoids.  Chief of DEA’s Drug and Chemical Evaluation Section Terrance Boos revealed that the agency had received several petitions on the issue and that they are actively in the process of modifying rules. 

Boos spoke at the DEA’s 2023 Supply Chain Conference in May.  He indicated that the agency’s regulations would be based on recommendations from the US Department of Health and Human Services.  The effort is meant to harmonize agency policy with the new reality of legal hemp. 

Intoxicating cannabinoids are under scrutiny in the US, with many lawmakers and regulators dismayed by the reality of hemp markets, which look far more like cannabis than an industrial supply.
