Maryland recently introduced laws that stipulated only licensed marijuana dispensaries could carry intoxicating hemp-derived cannabinoids like delta-8 THC. The law took effect in July, concurrent with rollout of the state’s adult-use cannabis program.
This prompted the Maryland Hemp Coalition to file a civil suit, arguing the law was unconstitutional. It alleges restrictions in the state’s new recreational cannabis market violate the Maryland Constitution’s equal protection and anti-monopoly clauses by effectively shutting down their businesses and excluding them from a tightly controlled market.
