South Carolina takes enforcement route

States have all handled the unfolding saga of the hemp industry differently. Starting with federal legalization in 2018, states took years in some cases to pass hemp legislation to allow for hemp cultivation. COVID delayed nationwide rule implementation, and states had a range of approaches to analytical testing, as well as a range of tolerance for THC content that federal rules have now superseded.

Most states have pursued legislative changes to empower them to police the emerging hemp/cannabis space. State attorneys interpret the overlap of federal law and their respective state constitutions differently. Most states have sought to avoid unnecessary litigation; others have charged ahead with enforcement.
