States Lead the Way in CBD Regulation

State legislatures are charting their own course with CBD regulation, filling a vacuum created by the lack of FDA regulations.  Virginia joins Colorado and Florida in recognizing CBD as an acceptable food ingredient, after governor Ralph Northam signed the bill that gives oversight of CBD to the Virginia Department of Agriculture and Consumer Services (VDACS).  Just last summer Virginia’s policy was to prohibit CBD production and extraction based on FDA guidance.  They quickly reversed course.

 

Florida has also allowed for CBD in food and beverages and is also overseen by their agriculture department, FDACS.  In Colorado, the Colorado Department of Public Health and Environment oversees CBD products.  The one thing these three states have in common is that the oversight bodies have a mandate to actively police store shelves, looking for proper labeling, and randomly testing…
