Hemp Derived Cannabinoids Face Growing Headwinds in Key Markets

New York cannabis regulators approved revised rules for hemp-derived cannabinoids during the NY Cannabis Control Board (CCB) November 17 meeting.  The new regulations place stringent limits on THC content and expressly forbids isomerized products like delta-8 THC.

The rules were originally part of emergency regulations adopted in July in response to a proliferation of intoxicating hemp-derived cannabinoids.   Hemp stakeholders then petitioned the state Supreme Court, arguing that the CCB acted in an “arbitrary and capricious” manner when they approved the rules, and failed to identify an “emergency” to justify the quickly enacted rules.
